Avoid the protocol shortcut
An EFF report on a court ruling that embedding links can be lawful under a new test is relevant to Web3 builders because products frequently mix content-addressed storage, indexes, gateways, previews, and social sharing. Calling a system decentralized does not answer what the product itself presents, promotes, or controls.
Map the product's role
Document whether a service hosts material, provides a link, generates a preview, ranks a result, or runs a gateway. Each role can create a different legal and operational question. Product teams should seek qualified legal advice for their jurisdictions instead of extrapolating one ruling into a global policy.
Design a response path
Even when a product is not the original host, it should know how it receives notices, records decisions, and handles abusive or illegal material. Clear process is more credible than a claim that architecture removes responsibility.
